Terms and conditions

1. These terms are negotiable, provided they are discussed and agreed to prior to me starting the commission. If we have not agreed to any changes to the contract by this stage, the terms listed below stand.

2. Payment

2.a. Payment by Paypal only. My Paypal address is hamstertoybox@gmail.com.

2.b. Commissions valued at less than or equal to $200 must be paid in full before I start. If the commission is worth over $200, I will accept a 50% deposit before I start, with the remaining 50% to be paid once I have completed the line art. There will be a small fee for paying in installments, to cover additional Paypal fees.

3. The Commission Process

3.a For commissions costing less than or equal to $65/image

3.a.a. Upon receiving payment I will send the commissioner a completion date. I will treat this date as an absolute deadline and do everything in my power to finish the art by this date.

3.a.b. In the unlikely event I am unable to finish the artwork by the completion date (Due to, for example, severe illness, personal crisis etc.) I will contact the commissioner as soon as possible and offer a full or partial refund dependent on what stage the work is at.

3.a.c. If the commissioner requires the work sooner I may be able bring the date forward, depending on my workload. The sooner I am advised of this the higher the chance I will be able to accommodate the request.

3.a.d. The finished product will be a high resolution (300 dpi) PDF emailed to the commissioner, along with a smaller JPEG. No physical copy will be printed and sent, unless requested at extra cost. For real media commissions (I.e., sketches), let me know as soon as possible if you would like the physical copy, as it may affect what materials I use.

3.b For commissions costing greater than $65/image

3.b.a. Upon receiving payment/deposit I will present the commissioner 3 thumbnail sketches to choose from. The commissioner can request up to 3 alterations without incurring extra charges. I may reuse any rejected sketches on future commissions.

3.b.b. Upon agreeing on a thumbnail I will send the commissioner a completion date. I will treat this date as an absolute deadline and do everything in my power to finish the art by this date. If I have received the full payment the completion date will be for the finished piece. If I have received a 50% deposit the completion date will be for the line art, with the final completion date given upon receipt of the remainder of the payment.

3.b.c. In the unlikely event I am unable to finish the artwork by the completion date (Due to, for example, severe illness, personal crisis etc.) I will contact the commissioner as soon as possible and offer a full or partial refund dependent on what stage the work is at.

4. Changes to final piece

4.a. If the commissioner and I agree that I have made a mistake in the image then I will amend the final image at no additional cost. Mistakes may include:

  • Huge anatomy errors, i.e. drawing hands the wrong way around.
  • Character design errors, i.e. forgetting to add wings to a character – provided I was made aware of this detail before starting the piece. If the references and the information you initially send me include the wings, I will amend the final piece. If they don’t, then I change the image without incurring extra cost. The better the information you provide, the more accurate the final image.

4.b. If you realize you’ve forgotten to make me aware of a detail, let me know as soon as possible and I will try to accommodate.

4.c. If you would like the final piece changed but we do not agree that I have made a mistake, I can make the change for an additional cost. The cost depends on how much time the change will take me.

5.  Allowed content

5.a. I will not draw:

  • Underage characters in a provocative manner.
  • Anything derogatory or hateful.

5.b. Violence/gore, erotica, fetish art and porn will be considered on a case-by-case basis. I reserve the right to refuse any subject matter.

6. Use of images

6.a. I may use the image in my personal galleries and in promotional material. If for any reason you would prefer me not to upload it until after a certain date, I will be happy to oblige. I will normally mention the online name of the commissioner (f known) in image descriptions – please let me know if you’d rather remain anonymous.

6.b. I may sell prints and merchandise of the image. I will retain all rights to the artwork.

6.c. The commissioner can upload the image online as long as credit is given. The commissioner may modify the image (For example, crop it to create an avatar) for personal use. The commissioner may make prints of the image for personal use. The commissioner cannot profit from the image in any way. The commissioner retains all rights to their respective characters.

 

7. Cancellations

7.a I reserve the right to cancel a commission due to poor communication, rude or inappropriate behaviour, or inability to communicate in clear/effective English, or unforeseen inability to complete the commission.

7.b. In the event that I cancel due to an issue with the commissioner I will refund all or part of the payment (Minus Paypal fees), depending on how far through the commission I am.

7.c. In the event that I cancel due to circumstances at my end, I will offer the commissioner a choice of either:

A high resolution image of the last completed stage (For example – if I cancel during shading I will offer a flat colour image) and a partial refund.

or

A full refund.

Under these circumstances I will cover the Paypal fees.

7.d If the commissioner wishes to cancel, refunds will be issued as follows:

  • Before work starts – full refund minus Paypal fees and a 5% convenience charge.
  • During thumbnail stage (If applicable) – a 50% refund.
  • During work on the final piece – 0-50%, depending on amount of work that has gone into this stage.

8. Other
8.a. Communication via email only (hamstertoybox@gmail.com). Private messaging systems are too unreliable.

8.b. I will complete each piece to the best of my ability, and am continuously working on improving my skills. However, if I am requested to draw something I believe I will struggle with, I will warn the commissioner before agreeing to the commission.

8.c. By submitting payment, the commissioner agrees to the above terms.
